Ornimus for Brands
Terms of Service
The agreement between your business and Ornimus LLC when you order a game or quiz from us.
Last updated: October 6, 2026
1. About these terms
These Terms of Service ("Terms") are an agreement between you and Ornimus LLC, a Delaware limited liability company ("Ornimus", "we", "us", or "our"). They apply when you use ornimus.com/partners, take our quiz, place an order, send us your brand kit, or use any game, quiz, or other work we build for you (together, the "Services").
"You" means the business or person placing the order. If you order on behalf of a business, you confirm that you are allowed to accept these Terms for that business, and "you" includes that business.
By ticking "I agree to the Terms of Service" at checkout, or by using the Services, you agree to these Terms, our Refund Policy, and our Privacy Policy. If you do not agree, please do not order.
2. What we offer
We design and build custom branded games and quizzes for businesses. Our current packages are:
- Starter: The Branded Quiz, a one time build of $750. A custom quiz with up to 10 questions and 3 to 5 personalized results, your branding, and email capture connected to your email tool.
- Signature: The Branded Mini Game, a one time build of $2,500. A custom mini game with quick 30 to 90 second rounds, original art, email capture, a leaderboard and shareable score, optional discount code rewards, and a results report.
Every game we build is a mini game: short, polished rounds, not a full video game. The exact features of each package are described on our website at the time you order, and that description forms part of these Terms.
Optional extras include a seasonal refresh ($400), an extra week of revisions ($150), and an additional language ($250). Prize games, training games for your team, and custom projects outside our packages are quoted separately by email and are governed by these Terms plus any written quote we send you.
3. Orders, prices, and payment
- Payment processor. All payments are processed by Whop. When you pay, you also agree to Whop's own terms. We never see or store your full card details.
- One time payments. Builds, extras, updates, and hosting renewals are one time payments in US dollars. We do not charge monthly fees, and nothing renews automatically.
- When your order is confirmed. Your order is confirmed once Whop confirms your payment. Extras chosen at checkout are paid separately right after your package and are only confirmed once paid.
- Taxes. Prices do not include any sales tax, VAT, or similar tax that may apply. Where tax applies, it is added at checkout.
- Price changes. We may change our prices at any time. Changes never affect an order you have already paid for.
4. Founding client offer
Our first five clients may receive 30% off their Starter or Signature build using the code applied at checkout. The offer applies to the build price only, not to extras, updates, or hosting, and is limited to one use per client.
In exchange, you agree to (a) give us a short written testimonial about your experience, and (b) allow us to share your game and its general results, such as the number of players, signups, and reward codes used, on our website, social media, and sales materials. You may ask us to leave out specific figures you consider confidential, and we will respect that.
5. Your brand kit and materials
After you pay, you send us your brand kit through our onboarding form: your logo, colors, product images, reward details, and anything else we need ("Your Materials").
- You confirm that you own Your Materials or have permission to use them, and that using them in your game will not infringe anyone else's rights or break any law.
- You give us a nonexclusive license to use, copy, edit, and display Your Materials only as needed to build, host, support, and (where Section 4 applies) showcase your game.
- You are responsible for the accuracy of Your Materials, including product names, prices, claims, and discount codes.
6. When work starts and timelines
Work starts when we receive your completed brand kit. This moment matters for refunds (see our Refund Policy).
Our usual timelines, counted from when your brand kit arrives, are about 7 to 10 days for a Starter quiz and about 2 to 3 weeks for a Signature game. These are good faith estimates, not guarantees. Delays in receiving materials, feedback, or answers from you will extend the timeline.
If we do not receive your brand kit within 90 days after payment, we may close your order and give you a full refund, since work has not started.
7. Previews and revisions
When your first preview is ready, we email you a link. For the 7 days that follow, you may request as many changes as you like within the original scope: colors, wording, products, images, your reward, and small art or layout tweaks.
New features, extra levels, a different game style, or new characters are outside the original scope and are quoted separately. You can extend the revision window by buying an extra week of revisions ($150).
If we do not hear from you within 7 days after the first preview, or after any later preview, we will treat the game as approved and may launch it or hand it over.
8. Launch and hosting
- Included hosting. Every build includes 12 months of hosting from the date your game launches, on your own address (such as play.yourbrand.com, which you control) or embedded in your site.
- After 12 months. We will email you before your hosting year ends. You can keep your game online for another year for $120, or ask for your game files at no cost and host the game yourself. If you do neither, we may take the game offline when the year ends. Your files remain available on request for 30 days after that, and we may delete them after that time.
- Leaderboards and hosted features. Leaderboards, automatic leaderboard resets, and our backup copy of collected emails work only while we host your game. If you host the game yourself, the game keeps working, but leaderboards turn off.
- Availability. We aim to keep hosted games online and working, but we do not promise uninterrupted availability. Planned maintenance, outages of our hosting providers, and events outside our control may cause downtime.
9. Bug fixes and updates after launch
For 30 days after your game launches, we fix bugs in our work at no cost. A bug means the game does not work as built and approved; it does not include new requests or changes.
After those 30 days, fixes and small updates, such as new wording, colors, products, or a new discount code, cost $75 each. Bigger changes, such as new levels, a new style, or new characters, are quoted by email before we start. We are not responsible for problems caused by changes made by you or anyone else, by your own hosting, or by third party services such as your store or email tool.
10. Player data, emails, and marketing
- You own your leads. Emails and other details that players share in your game belong to you. We send them to your email tool and keep a backup copy while we host your game, as described in our Privacy Policy.
- We act on your behalf. For player data, you decide why and how it is used, and we process it only to provide the Services to you.
- Your responsibilities. You are responsible for how you use player data and for following marketing and privacy laws that apply to you, such as CAN SPAM and, where relevant, GDPR or state privacy laws. Our games include a clear consent checkbox, and you must not use player data in ways players did not agree to.
- Connecting your tools. If you give us an API key or account access for your email tool, you confirm you are allowed to, and you may revoke it at any time.
11. Rewards, discount codes, and prizes
You create any discount code in your own store and are responsible for honoring it, testing it before launch, and telling your staff about it. We are not responsible for losses from codes that are shared, misused, or redeemed more than you expected.
We do not build spin the wheel or scratch card games unless you request one as a custom project. If your game offers prizes, sweepstakes, or contests, you are responsible for following the rules and laws that apply to them.
12. Who owns what
- You own Your Materials, including your logos, product images, and brand names.
- Your game. Once you have paid in full, you may use your finished game, including the custom art we create for it, for your business without time limit.
- Our tools. We keep ownership of our underlying code, game engines, templates, know how, and general designs that are not specific to your brand. We grant you a nonexclusive, perpetual license to use them as part of your game. If you take your game files to host yourself, this license lets you host and run that game for your business, but not resell or reuse our code for other projects.
- Showing our work. Except where the founding client offer applies, we will only feature your game in our portfolio with your permission.
13. Acceptable use
You agree not to use the Services to create or promote anything that is illegal, deceptive, hateful, or sexually explicit, that targets children under 13, that infringes someone else's rights, or that promotes gambling. We may refuse, pause, or end work on a project that breaks this section. If we end a project for this reason after work has started, no refund is due.
14. Refunds and cancellations
You can cancel and receive a full refund before work starts. Once work starts, payments are not refundable. Full details are in our Refund Policy, which forms part of these Terms.
Please contact us before opening a dispute or chargeback with your bank. Most issues can be solved quickly by email.
15. No guaranteed results
Games can help you collect leads and sales, but we cannot promise any particular number of players, emails, orders, or revenue. Figures from our earnings calculator, examples, and statistics on our website are estimates and illustrations, not guarantees.
Except as stated in these Terms, the Services are provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non infringement.
16. Limitation of liability
To the fullest extent allowed by law, Ornimus will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from the Services, even if we were told they were possible.
Our total liability for any claim relating to the Services is limited to the amount you paid us for the Services in the 12 months before the claim arose. Some places do not allow these limits, so some may not apply to you.
17. Your responsibility to us
You agree to defend and compensate Ornimus for claims, losses, and costs, including reasonable legal fees, that arise from Your Materials, your use of player data, your rewards, prizes, or promotions, or your breach of these Terms.
18. Third party services
The Services rely on other companies, including Whop for payments, our hosting and form providers, and the email tools and stores you connect. Their services are governed by their own terms, and we are not responsible for their actions, outages, or changes.
19. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. Any dispute that cannot be resolved informally will be brought only in the state or federal courts located in Delaware, and you and Ornimus consent to their jurisdiction.
Before bringing any claim, both sides agree to try to resolve it informally by email for at least 30 days.
20. General terms
- Changes to these Terms. We may update these Terms from time to time. The version in effect when you place an order applies to that order. We will post the date of the latest update at the top of this page.
- Entire agreement. These Terms, our Refund Policy, our Privacy Policy, and any written quote we send you make up the full agreement between you and us about the Services.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. If we do not enforce a right right away, we have not given it up.
- Assignment. You may not transfer your rights under these Terms without our written consent. We may transfer ours as part of a sale or reorganization of our business.
- Events outside our control. We are not responsible for delays caused by events beyond our reasonable control.
